In 2008, Jane Doe, a U.S. Citizen, went on a cycling vacation to France and fell in love with professional European cyclist Sylvan Alien, a native and citizen of France.

During their whirlwind international romance, Sylvan would visit Jane in the U.S., entering the country under the Visa Waiver Program.

On Jane’s last visit to France in July 2009, and after finishing his 8th Tour de France, Jane and Sylvan decided to marry.

Sylvan once again entered the U.S on October 1, 2009 under the Visa Waiver Program and while in the U.S., they headed off to Las Vegas and had a fabulous Elvis drive-thru wedding on October 15, 2009.

Once married and while Sylvan was still admitted to the U.S. under the Visa Waiver Program, Jane filed the appropriate Form I-130 (Visa Petition for Alien Relative) to USCIS to start the application process for Sylvan to get his “green-card” or lawful permanent resident card. As Sylvan is considered an “immediate relative” as Jane’s husband, USCIS approved the I-130 visa petition on November 1, 2009 (it usually takes longer than that, but assume for the question it was that fast).

Based on the information provided above, answer the following questions- each answer should be a minimum of 200 words with citation to sources to support your answers:

1. In November 2009, Sylvan went back to France after the I-130 was approved to gather his personal belongings. Can Sylvan finish the application process to become a lawful permanent resident in France? If he can, then how does he re-enter the U.S. and what is his staus upon re-entry?

2. What if Sylvan does not want to go back to France- can he stay in the U.S. and adjust his status here? Why/Why not?

3. Assume for the purposes of this question that when Jane and Sylvan decided they wanted to marry in July 2009, Jane headed back to the U.S. and Sylvan stayed in France to finish up his personal business before moving to the U.S and marrying Jane. As Jane’s fiancé, how can Sylvan enter the U.S. to marry Jane?
