1. A fishing vessel suffers an engine failure during a storm and calls the Coast Guard for assistance. The Coast Guard sends out a patrol boat that takes the disabled vessel in tow. During the night, the fishing vessel begins taking on water and sinks before the crew can radio the Coast Guard cutter. Everyone on board the fishing vessel drowns. What are the issues relating to the liability of the Coast Guard, the Coast Guard vessel, and its captain? What additional facts are necessary to resolve those issues? How would they be resolved by the courts?
